OINK UPLOADERS SENTENCED TO COMMUNITY SERVICE The four uploaders in question pleaded guilty last December to making music available via the OiNK community without the permission of the content owners. Sentenced at Teesside Crown Court, uploader one Steven Diprose got 180 hours community service and was ordered to pay £378 court costs. Uploader two Michael Myers was ordered to pay a £500 fine. Uploader three got 100 hours community service and £378 costs. Uploader four James Garner got 50 hours community service and £378 costs. There seems to be mixed opinions to the sentences among the BitTorrent community. Some reckon the judge too readily accepted the record industry's case for the four uploader's actions causing them commercial damage. Others, though, reckon the OiNK boys all got off quite lightly, and that the sentences won't provide that big a deterrent to those who continue to illegally share music via Torrent trackers and other web services. That said, sources say that only strong legal representation and a plethora of good references from respectable citizens helped the defendents avoid custodial sentences, which were considered by the court. TorrentFreak quote a source close to one of the convicted infringers thus: "[The Judge] swallowed the prosecution line completely that initial seeders were causing major damage to the copyright holders, and particularly uploaders who uploaded before the official release date. The fact that all the early uploads were only one or two days early and that three out four of the uploaders bought their CDs online did not sway him. All the retailers, quite naturally, denied this". The cases against a fifth uploader to the OiNK community, plus the guy behind the service, Alan Ellis, are ongoing and will return to court in March. -------------------------------------------------- BUSINESS AS USUAL AT 2ENTERTAIN DESPITE CO-OWNER ADMINISTRATION With most of the Woolworths empire already dismantled that's only really news in relation to 2Entertain, the DVD and music company jointly owned by the Woolworths Group and the BBC's commercial division BBC Worldwide. 2Entertain is a video publisher, and also owns a production company and the Demon Music Group, one of the UK's biggest independent record companies. 2Entertain has so far managed to generally avoid being affected by the chaos caused by the liquidation of its co-owner and sister firms, and the management there yesterday insisted that while the Woolworths Group was in administration it remained a going concern. BBC Worldwide is in talks with the Woolies administrator regarding the sale of the former retailer's 40% stake. A spokesman for the Beeb said yesterday: "BBC Worldwide would like to make it clear that that 2Entertain is not in administration. 2Entertain remains a profitable and well funded business and BBC Worldwide remains in talks with the administrator of Woolworths Group plc regarding the sale of the company's 40% stake in the joint venture". -------------------------------------------------- EDDY BIGS UP SNOWSIDE - NEW ACTS ADDED TO LINE UP The festival is being co-programmed by Eddy and his Remix team and the guys behind the Secret Garden summer festival, and Metronomy, Shy Child and Vitalic have just been added to a line up that already boasts live sets from Infadels, Kissy Sell Out, Evil 9, A.Human, The Japanese Popstars, Slagsmalsklubben, Man Like Me and Eddy's own outfit The Losers, plus DJ sets from the likes of James Priestly, DJ Fresh, TC, CTRL Z, Kris Menace, South Central, Qemists, Japanese Popsters, Brookes Brothers, Matrix and Futurebound, Rhysmix, Breakfastaz and Stereo:Type. Writing in CMU's sister bulletin the Remix Update, Eddy says: "I am just beside myself with excitement over Snowside festival. I cannot stress how much fun this is going to be, with Secret Graden hooking up with the Remix and all those legends coming out to get drunk and fall over in the snow". He continues: "This is a very 'boutique' experience, exclusive and lovely. It will be a unique opportunity to hang out and spend quality time with some really cool and talented people. The combination of altitude and hot-wine-beverages make for very happy times, and we'll all be in there together, day and night, drinking, boarding, smoking and joking". The band's Howard Donald admitted that the band's 1996 break-up left him feeling suicidal. "I didn't want us to split... I was pissed off", he is quoted as saying. "I walked out the hotel and I wanted to throw myself into the Thames ... but I thought 'knowing me I'll end up in the middle of the river and the tide will go out and I'll be in the papers stuck in the Thames mud'". Gary Barlow, meanwhile, coughed to having had encounters with fans. He told the magazine: "As soon as we went abroad we wiped our memories of what we were allowed to do. In Amsterdam I slept with a fan. A chubby Dutch girl. And carried on from there. We just had a lot of fun. I don't feel any guilt about how much sex I had". Mark Owen also admitted that he "did all right" with the groupies, but regretted it, having been in a relationship at the time. ZAPPA WIDOW LOSES CASE AGAINST ZAPPA-FEST But a court in Dusseldorf has thrown out Zappa's case, ruling that organisers of Zappanale can continue to use that name, plus the late musician's image in its branding and on its merchandise, because doing so, the judge said, did not violate any of Gail Zappa's rights. The widow's case was seemingly weakened because she could not prove she used Zappa's name and image herself in Germany, and also because she had known about the event since its launch in 1990 (three years before her husband's death) and had only chosen to take action in 2008. Thomas Dippel, who runs the fan club who promote the festival, told reporters: "We have always been certain that we have the older rights. We have also patented the name of the festival with the German patent office. Gail Zappa only applied for the patent of her own rights in 2002". The ruling means the 2009 Zappanale festival can go ahead from 12-16 Aug as planned. -------------------------------------------------- THRILLER VIDEO DIRECTOR SUES OVER ROYALTIES Anyway, this is all relevant to the pop courts because the director of the original video, John Landis, has just sued the singer claiming he is owed royalties relating to the famous pop promo. Whether the news of the Broadway project prompted the lawsuit I'm not sure. According to his contract with Jacko, Landis is due 50% of any revenues generated by the video or its accompanying documentary. He is also due regular revenue updates. He claims that he has heard nothing for four years. He is suing Jacko and his people for "fraudulent, malicious and oppressive conduct". It's thought Landis may be due up to $1 million in unpaid royalties. MCCARTNEY AND RADIOHEAD ADDED TO GRAMMY LINE UP As previously reported, Jay-Z is nominated in six categories, as is Kanye West, but it's Lil Wayne who leads the nominations with eight. McCartney, who will be supported in his performance by Dave Grohl on drums, is nominated twice. Radiohead have five nods. -------------------------------------------------- ESTEFAN IS BMI ICON According to the organisation, the Icon Award is given to artists judged to have had "a unique and indelible influence on generations of music makers". Past Icon winners include Carlos Santana and Gustavo Santaolalla. THOSE DANCING DAYS RELEASE EPONYMOUS SINGLE GLADE FESTIVAL ANNOUNCES NEW SITE Nick Ladd, Glade's director, says this: "We are really happy with our new home, it's really tailor-made for us - beautiful countryside, an event friendly council and no neighbours, so we can enjoy dance music as mother nature intended - outdoors and loud!" Details of this year's line up are expected to be announced in the next few weeks. Listening to tracks like 'Chime' and 'Belfast' in such a dramatic setting is going to be a highlight of the weekend". ALBUM REVIEW: Ladyfinger (ne) - Dusk (Saddle Creek) PRODUCER MANAGERS SAY MORE COLLABORATION NEEDED TO PROTECT PRODUCERS' INTERESTS Explaining the background to the meeting, producer manager Stephen Budd, who led the meeting, told CMU: "Although the role of the record producer is still essential in the quality record making process, times are tough indeed as producers face drastically reduced budgets and minimal or no earnings at all from royalties, meaning many are struggling to survive. On top of this, producers are being continually pressurised into working 'on spec' and there are many examples of them being played off against each other in an unfair manner by unscrupulous executives. If the industry wants quality recordings, there is a need for the representatives of producers to work closely together to look at how deals and budgets can be restructured to allow recording process to continue to employ producers in a viable manner. The MMF recognise the essential role of the producer and have re-constituted the PMG to aid this process. I'm delighted by the support we have received". In addition to the producer managers in attendance, other music industry sectors were represented at the debate. Producers themselves, obviously, led by the boss of the Music Producers Guild Mike Howlett, plus Feargal Sharkey from cross-sector trade body UK Music, Jazz Summers and Dennis Muirhead from the artist management side of the MMF, the British Academy Of Composers and Songwriter's Patrick Rackow and Maureen Droney Executive Director of the US's Recording Academy. Commenting on the event, Howlett adds: "This meeting was an important opportunity to discuss the pressing issues facing record producers in the current recording industry - how do we get paid when records are becoming increasingly regarded as a loss-leader for live promotion, and often there is no major label involvement to provide reliable royalty tracking? In times like these it is even more necessary for people in the recording industry with common aims to work together to strengthen our voice. Clear ideas have come from this meeting that are leading to future collaboration". Following last week's meeting, subject-specific sessions are now planned, some run in conjunction with the MPG. A wiki website will also be set up so producer managers can share information. -------------------------------------------------- WIN REAPPOINT WENHAM TO TOP JOB Four Vice-chairman were also appointed at the meeting in recognition of the widening of WIN's activities, and the need for representation in different regions. The Vice-chairs will be David Vodicka from the Australian Independent Records association, Mark Chung from German independents body VUT, Portia Sabin representing the American Association Of Independent Music and Duncan McKie from the Canadian Independent Record Production Association. -------------------------------------------------- FAC TO MEET NEXT WEEK As previously reported, the FAC was officially launched at In The City last year. Although spearheaded by the Music Managers Forum, it is an independent body that will exist to represent so called featured artists, they being the artists whose names appear on the front of albums - ie the musicians and singers you all know the names of, rather then session musicians whose names only appear in the small print. Although in theory those artists could join the Musician's Union, some reckon a separate body is needed to specifically represent their interests. Blur's Dave Rowntree, Radiohead's Ed O'Brien, Soul II Soul's Jazzie B, Master Shortie and Kate Nash have been leading the proceedings since the body's launch, and they are expected to report back to the Coalition's membership next week, on both their recent meeting with Culture Minister Andy Burnham, and on their proposals for how the organisation will work moving forward. Over 700 artists have already signed up to the Coalition, including Annie Lennox, Klaxons, Robbie Williams, Jools Holland and Kaiser Chiefs. -------------------------------------------------- NATIONAL GEOGRAPHIC LAUNCH RECORD LABEL The new label follows a recent deal between the Society and music publishing administrators Kobalt, who will administrate the publishing rights in 16,000 bits of music owned by National Geographic, presumably mainly originating from their TV programmes. -------------------------------------------------- SONY MUSIC APPOINT NEW CLASSICAL CHIEF He will report directly to Sony Music CEO Rolf Scmidt-Holtz, who said this: "Classical music not only remains a vital part of our company's DNA but also this is a business we are determined to grow and promote again. While genres like classical remain under tremendous pressure in the marketplace, we believe it has enduring appeal with consumers and we plan to harness it with a renewed commitment to strong leadership, a rich catalogue and a world-class roster". -------------------------------------------------- SMITHS SAY ALL OK DESPITE SALES DECLINE CEO Kate Swann told reporters: "As anticipated, trading conditions on the high street were challenging over the Christmas period. However, we continue to successfully deliver our strategy and maintain operational flexibility, increasing gross margins and accelerating our cost reduction plans. Looking ahead, we expect consumer spending in our markets to remain subdued and we have planned accordingly". So there you go. Do people still count Smiths as record sellers? The last one I went in seemed to be selling about 14 CDs. Oh well, I guess we should continue to report on them anyhow. Just for old time's sake. BEBO NOT FOR SALE, OK? But a Bebo spokesperson says this: "The whole thing is ridiculous and there is no truth in it at all". Asked about plans to better integrate Bebo with other AOL assets, the spokesperson added: "Social Inbox was launched in December and is just the first step in answering that fragmentation problem with Twitter, Flickr, AOL Mail and a recommendation tool. It was the first step and there's more to come - there's a lot of stuff to be layered over to build on that". RADIO 2 CHIEF APPOINTED In his new role running the nation's biggest radio station and its digital serious-music sister channel, Shennan will report to the BBC's Director Of Audio & Music Tim Davie, who said of the appointment: "Bob is an outstanding leader with extensive radio experience and a proven track record in station management. Bob's energy, enthusiasm and passion for Radio 2 will ensure that the station remains creative and vibrant". Shennan himself added: "Radio 2 is the cornerstone of UK Radio. 6 Music is at the forefront of digital radio. It is a privilege to be asked to lead the extraordinary creative forces of both stations". -------------------------------------------------- FUTURE PUBLISHING REVENUES UP Despite the increases, CEO Stevie Spring was cautious, warning investors she was guiding the business through "uncharted waters" and that the company was not "immune" to challenges from the downturn. She said in a statement: "Our focus this year is on guiding our business effectively through the uncharted waters of the current macroeconomic environment and ensuring we remain on course to deliver sustainable growth in the mid-term. While of course we're not immune to current challenges, we're mitigating these through the active management of our portfolio and through building in greater cost flexibility. We remain confident that we're in the best shape we can be to deal with whatever challenges lie ahead and are on track to deliver against expectations for the full year". THIS WEEK'S SUB.TV PLAYLIST A-List HALLIWELL ENGAGED AFTER WHIRLWIND ROMANCE The former pop star's management agency 19 apparently said in a statement: "We are delighted to announce the engagement of Geri Halliwell and Fabrizio Politi. As a token of their commitment to each other Fabrizio presented Geri with an engagement ring over the festive season. There are no immediate plans for marriage as the couple are enjoying their engagement". The pair met in a nightclub in Florence early in December, and reports suggest that the 'token' was a diamond ring worth more than £200k. -------------------------------------------------- NOEL GALLAGHER SAYS HIS GUITAR PLAYING IS AVERAGE Weller responded by saying "Bless him, but his playing is rudimentary.
